Answer of the day(10/09/17)-Aadhaar

In the background of SC declaring privacy as Fundamental Right, What are the conflicts between privacy and Aadhaar? What changes should be made in Aadhaar to make it more Compliant with the SC judgement.? (12.5 marks) 



Privacy is the state in which one is not observed or disturbed by other people. SC has declared privacy as fundamental right under Art 21 in  case.
This has again raised an issue of privacy wrt Aadhaar. Following is the conflict between privacy and Aadhaar

1.Aadhaar collects the personal biometric and demographic data, which may be misuse by government for targeting political opponent, sectarian target etc.
2.Such data collected can be hacked by others for profit or other motive. Thus violating the privacy of people.
3.Indvidual has no rights to delete the data collected, thus their rights get restricted.

Changes that should be made to make it more compliant with SC judgement are
1.Making it mandatory for the government to have more data secure technology 
2.Giving citizens choice to not provide the information 
3.Option to let individual delete their information 
4.Restricting access of data to just secretary level and not district court(as present provision provides) but just on HC order. 
5.Making official accountable wrt leakage of data to outside the government. 

Aadhaar is an important socio-economic step to provide various government's welfare service. It has to be made privacy Compliant so that people rights are not violated
