Q-SC has already declared transgender as third gender in NALSA case. In this background, elaborate on the steps taken by government for the betterment of transgender and what are the challenges in fullest realization of their rights?
Sol- Transgender are person whose sense of identity or gender is different from their birth sex. They are discriminated in various forms like lack of employment, education, social discrimination, lack identity.
But a progressive step was taken in 1994 when government recognized transgender as 'third sex'. And this recognition was extended to identity as 'third gender' by SC in 2014 NALSA case. SC provided them identity, recognition of their rights esp in education and employment.
In this backdrop, following steps have been taken by government for the betterment of transgender
1.Transgender rights bill introduced in 2016---providing right to education, no discrimination in any employment, right to property etc(though quota in employment wasn't included as asked by SC)
2.Option of third gender in various government document like passport
3.Kerala--1st state to unveil transgender policy, conducted beauty contest of transgender recently, employment in kochi metro etc
4.Tamil Nadu---transgender in police force
Challenges faced in implementation of policy for transgender
1.General discrimination against them in society which get translated into discrimination by government official including harassment by police. Thus restricting their access to various rights
2.Awareness among the transgender of various new rights provided is less
3.No talk of quota in jobs in the transgender bill----thus restricting their empowerment.
4.Social discrimination has an psychological effect, which restrict transgender in taking initiative to demand for their rights. Thus restricting their utilization of rights
We need to create awareness among people regarding their, skilled transgender and make policy more effective for the realization of rights by 4.9 transgender in the country.
